AMCK LEGACY DONATION TERMS AND CONDITIONS

This “Terms and Conditions” sets out the terms and conditions applicable to all donations, contributions an sponsorships made to AMCK Legacy Ltd (“us”, “our” “we”), a United Kingdom Limited Liability company by guarantee.

1 . PURPOSE AND OF DONATIONS

    1. AMCK Legacy Ltd exists to advance diversity, representation, and access in the commercial dance and creative industries through grants, mentorship, and partnerships. Donations, sponsorships, and other contributions (“Funds”) are accepted solely to support these objectives.
    2. Unless otherwise stated in writing, all Funds are treated as unrestricted donations, allowing AMCK Legacy to apply them to any of its programmes or operations consistent with its mission.
    3. AMCK Legacy is a non-profit company limited by guarantee and not currently a registered charity. Donations are not eligible for Gift Aid, and tax relief for donors may be limited under UK law.
  2. DEFINITIONS
    1. Donation: A voluntary gift of money or in-kind support made without expectation of goods, services, or promotion in return.
    2. Sponsorship: A payment or contribution made in return for agreed promotional or marketing benefits.
    3. Partnership Contribution: A hybrid arrangement combining philanthropic intent with limited agreed recognition (e.g. logo placement, event credit).
    4. HMRC rules distinguish these categories for tax and VAT purposes; classification will be confirmed in writing for each arrangement.

 

  1. ACCEPTANCE OF DONATIONS
    1. AMCK Legacy reserves the right to decline or return any donation if it conflicts with our mission, values, or reputation, or if the source of funds cannot be verified.
    2. All donors and sponsors must comply with UK anti-money-laundering and sanctions laws. AMCK Legacy may request due-diligence checks before accepting funds.
    3. Donations are non-refundable except in the case of demonstrable administrative error or overpayment.

 

  1. USE OF FUNDS
    1. Funds are applied solely to further AMCK Legacy’s objectives and programmes such as the AMCK 20 Honours and AMCK Legacy Grants.
    2. Restricted donations will be used as closely as possible to their stated purpose, subject to operational discretion.
    3. If the original purpose cannot be fulfilled, AMCK Legacy may redirect funds to the nearest aligned initiative, ensuring transparency with the donor.

 

  1. RECOGNITION AND PUBLICITY
    1. Corporate partners or sponsors may receive recognition (e.g. on event materials, websites, social media) as agreed in advance.
    2. All acknowledgements and placements are at AMCK Legacy’s editorial discretion and subject to brand guidelines.
    3. Donors must not imply endorsement, partnership, or exclusivity beyond what is agreed in writing.
    4. AMCK Legacy may withdraw recognition if a donor’s conduct risks reputational harm.

 

  1. FINANCIAL AND TAX TREATMENT
    1. AMCK Legacy operates on a not-for-profit basis; any surplus is reinvested in its objectives.
    2. Donations may not qualify for UK charitable tax relief or Gift Aid until charitable registration is achieved.
    3. Sponsorships or partnership payments with benefits may be treated as taxable trading income and subject to VAT.
    4. AMCK Legacy will issue appropriate receipts or invoices confirming payment classification.

 

  1. TRANSPARENCY AND REPORTING
    1. AMCK Legacy maintains full financial records of funds received and expended per Companies Act 2006 and HMRC standards.
    2. Annual accounts will be publicly available via Companies House.
    3. For major donors (over £10,000), AMCK Legacy may provide an annual impact report if requested.

 

  1. LIABILITY AND INDEMNITY
    1. AMCK Legacy accepts donations in good faith and shall not be liable for indirect or consequential losses arising from their use.
    2. Total liability for any sponsorship or partnership shall not exceed the value of the contribution.
    3. Donors agree to indemnify AMCK Legacy against claims arising from their materials, branding, or representations.

 

  1. DATA PROTECTION AND CONFIDENTIALITY
    1. Donor and partner information is processed under UK GDPR in accordance with AMCK Legacy’s Privacy Notice.
    2. Donor names may be acknowledged publicly unless anonymity is requested.
    3. Financial and personal data will not be disclosed without consent or legal obligation.

 

  1. ETHICAL AND REPUTATIONAL STANDARDS
    1. AMCK Legacy upholds high ethical standards in partnerships and expects the same of donors and sponsors.
    2. Funds will not be accepted from individuals or organisations involved in discrimination, exploitation, or unethical practices.
    3. AMCK Legacy may terminate relationships that conflict with its mission.

 

  1. VARIATION AND TERMINATION
    1. These Terms may be updated from time to time and published on the AMCK Legacy website.
    2. AMCK Legacy may terminate a partnership immediately in the event of serious breach or reputational risk.
    3. Termination does not affect accrued rights or prior obligations.

 

  1. GOVERNING LAW
    1. These Terms are governed by and construed under the laws of England and Wales.
    2. The courts of England and Wales have exclusive jurisdiction over any disputes arising from them.
